FUNDAMENTAL ISSUES IN 30 CASES REGARDING THE RIGHT OF PUBLICITY

This article aims to discuss the basic principles and cases of the right of publicity. The first section defines the right of publicity and the right to privacy and demonstrates their relationship. The second section addresses both federal and state laws that conflict with the right of publicity. The third section highlights 30 cases involving the right of publicity. The purpose of this section is to provide an understanding of right of publicity issues. The conclusion observes that the right of publicity could be construed as the fifth intellectual property right, provided that one’s self and one’s characteristics are intangible and valuable. If so, then the right of publicity could be considered a form of intellectual property.
